A deed of transfer is a registered document by which the transferor actually transfers rights in immovable property — such as a society flat with membership, a shop, a gala, tenancy rights or occupancy rights — to the transferee. It is usually executed after an agreement to transfer, once consideration is paid and the society, landlord or authority has consented. It is stamped like a conveyance on the market value of the rights and registered with 1% fee, capped at ₹30,000.

Society transfer after registration
For a co-operative society flat, the society transfers the share certificate and membership to the new owner after receiving the registered transfer document, the membership application and the transfer premium as per its bye-laws (subject to the government cap). Under the society bye-laws the managing committee must decide within the prescribed period, and a society cannot refuse a transfer without valid reasons.

Frequently asked questions
What is a deed of transfer?
It is the registered document that actually transfers rights in a flat, shop, gala or tenanted premises from one person to another, usually after an agreement to transfer and the required consents.
Is a deed of transfer the same as a sale deed?
Not always. A sale deed transfers full ownership; a deed of transfer is used where the rights are membership, tenancy or occupancy rights, though the stamp duty treatment is often similar.
What is the stamp duty on a deed of transfer?
Generally like a conveyance on the market value of the rights transferred, with credit for duty already paid on a registered agreement to transfer where the law allows.
Do I need society permission?
Yes for society flats and shops. The society records the transfer and issues the share certificate in your name after registration.
Can tenancy rights be transferred by a deed of transfer?
Yes, with the landlord’s written consent. The landlord then issues rent receipts in the incoming tenant’s name.
