A lease deed transfers the right to enjoy immovable property for a fixed term in return for rent or a premium. Leases for more than one year must be registered. In Maharashtra, stamp duty on a lease under Article 36 is charged as a conveyance on a share of the market value that rises with the lease term — from 10% of market value for leases up to 5 years to 90% for leases of 30 years or more. Leave and licence agreements are charged separately at 0.25%.
Lease deed stamp duty in Maharashtra
| Lease term | Stamp duty (Article 36) |
|---|---|
| Up to 5 years | As conveyance on 10% of market value |
| More than 5, up to 10 years | As conveyance on 25% of market value |
| More than 10, up to 29 years | As conveyance on 50% of market value |
| 30 years or more, perpetual or indefinite | As conveyance on 90% of market value |
Premium, deposits and rent terms are also considered in the final computation, and specific rules apply to certain government leases. We confirm the exact duty before you sign. For terms up to 60 months, a leave and licence agreement at 0.25% is often more economical if a licence meets your needs.

Frequently asked questions
Is registration of a lease deed compulsory?
Yes. Under Section 17 of the Registration Act, leases of immovable property for more than one year, or reserving yearly rent, must be registered.
What is the stamp duty on a lease deed in Maharashtra?
Under Article 36 it is charged as a conveyance on a percentage of market value that depends on the term: 10% for up to 5 years, 25% for 5–10 years, 50% for 10–29 years and 90% for 30 years or more.
Should I sign a lease or a leave and licence agreement?
For residential and most commercial lettings up to five years, leave and licence is common and much cheaper to stamp. A lease suits long terms, built-to-suit buildings, land leases and cases where the occupier needs a transferable or mortgageable interest.
Can a lease deed be registered online?
No. Lease deeds are signed at the Sub-Registrar office. Only leave and licence agreements can be e-registered with doorstep biometrics.
Can a company take property on lease?
Yes. The authorised signatory signs with a board resolution, and the company’s PAN and incorporation documents are submitted.
