Rent agreements in Pune must be registered under Section 55 of the Maharashtra Rent Control Act. The cheapest and fastest way is e-registration: the agreement is drafted online, stamp duty (0.25% of total rent plus 10% of the deposit per year) and the ₹1,000 registration fee are paid online, and owner, tenant and two witnesses verify their Aadhaar biometrics at home. The registered PDF usually arrives in 2–4 working days.
Is a registered rent agreement compulsory in Pune?
Yes. Section 55 of the Maharashtra Rent Control Act, 1999 says every agreement for leave and licence or letting of premises entered into after the Act came into force must be in writing and registered under the Registration Act, 1908. The duty to register lies on the landlord.
Two consequences follow if you skip it:
- Penalty: the landlord can face imprisonment of up to three months, a fine of up to ₹5,000, or both.
- Burden of proof: in a dispute, the terms stated by the tenant are presumed correct unless the landlord proves otherwise. For an owner trying to recover a flat, this alone is reason enough to register.
A notarised agreement on ₹100 or ₹500 stamp paper is a common shortcut, but notarisation is not registration. It doesn’t meet Section 55 and usually doesn’t satisfy passport offices, banks or employers who ask for a “registered rent agreement”.
Leave and licence vs lease: why Pune uses leave and licence
Under a lease (Section 105 of the Transfer of Property Act) the tenant gets an interest in the property. Under a leave and licence the occupant only gets permission to use it; no interest in the property is created. Since the Rent Control Act’s protection against eviction is weaker for licensees, owners in Maharashtra overwhelmingly use leave and licence agreements for flats, shops and offices.
The licence can run for any period up to 60 months. The 11-month term is a habit, not a legal requirement — registration is compulsory either way.
How much does a rent agreement cost in Pune?
Total cost = stamp duty + registration fee + document handling charge + service fee.
Stamp duty formula
Stamp duty is 0.25% of the sum of: (a) rent for the whole term, (b) any non-refundable deposit or advance rent, and (c) 10% of the refundable deposit for each year (or part year) of the term. The result is rounded up to the next ₹100, subject to a minimum of ₹100.
| Scenario | Total rent | 10% of deposit × years | Base | Stamp duty |
|---|---|---|---|---|
| ₹15,000/month, ₹50,000 deposit, 11 months | ₹1,65,000 | ₹5,000 | ₹1,70,000 | ₹500 |
| ₹28,000/month, ₹1.5 lakh deposit, 11 months | ₹3,08,000 | ₹15,000 | ₹3,23,000 | ₹900 |
| ₹45,000/month, ₹3 lakh deposit, 24 months | ₹10,80,000 | ₹60,000 | ₹11,40,000 | ₹2,900 |
If rent increases during the term (for example 5% after 12 months), the total rent includes the higher amount for the later months.
Registration fee
₹1,000 where the property is within a municipal corporation or council (all of PMC and PCMC), and ₹500 in rural areas. A document handling charge is added by the department.

Names, property address, rent, deposit, term, start date, lock-in and notice period.

Your service provider drafts the agreement in the IGR e-registration format and both parties approve it.

Seven mistakes landlords and tenants make
- Relying on a notarised agreement. It isn’t registration.
- Wrong property address or missing flat/wing number — registered documents can’t be edited later.
- No inventory list, leading to deposit disputes.
- No lock-in clause, so a tenant can leave after a month.
- Undeclared deposit to save stamp duty — the saving is a few hundred rupees and the risk is the whole deposit.
- Missing renewal date. An expired agreement leaves both sides unprotected; set a reminder a month before.
- Not informing the police where your jurisdiction requires tenant information — ask your provider what applies to your area.
Renewal, early exit and changes
A registered agreement can’t be extended by a letter. At the end of the term you register a fresh agreement, with stamp duty on the new term. If the tenant leaves early, the lock-in and notice clauses decide who pays what; no cancellation deed is usually required for an expired or terminated leave and licence agreement. If the owner sells the flat, the buyer should sign a new agreement with the tenant.
Frequently asked questions
Can I make a rent agreement online without visiting any office in Pune?
Yes. Under e-registration, drafting and payment are online and biometrics are taken at your home or office by an authorised service provider. No Sub-Registrar visit is needed if all parties’ Aadhaar biometrics authenticate.
What is the stamp duty for an 11-month rent agreement in Pune?
0.25% of (11 months’ rent + 10% of the refundable deposit). For ₹20,000 rent and ₹1 lakh deposit this is 0.25% × ₹2,30,000 = ₹575, rounded to ₹600.
Is police verification needed separately?
Tenant information requirements depend on the police jurisdiction. Ask your service provider whether separate intimation is needed for your address.
Can witnesses be from the service provider’s staff?
Yes. Any adult with Aadhaar-linked biometrics can be a witness.
Is a registered rent agreement valid as address proof?
Yes. Registered leave and licence agreements are widely accepted as address proof by banks, passport offices and telecom companies.
