Power of Attorney for NRIs: Managing or Selling Property in Pune from Abroad

Living in the US, UK, UAE or Australia and need to sell, rent or manage a flat in Pune? A correctly drafted and adjudicated power of attorney lets a trusted person act for you — here is the exact process.

Short answer

An NRI can appoint a person in India through a power of attorney signed before the Indian embassy or consulate, or before a local notary with an apostille. The original is sent to India and must be adjudicated and stamped by the Collector of Stamps in Maharashtra within three months of arrival. Once stamped (and registered if it concerns immovable property), the attorney can sign sale deeds, rent agreements and bank documents on the NRI’s behalf.

Why NRIs need a power of attorney

Property transactions in Maharashtra require parties to appear before the Sub-Registrar (or authenticate biometrically). Flying to India for each step — signing the agreement, the sale deed, the society transfer, the bank NOC — is expensive. A power of attorney lets a parent, sibling or friend in Pune do it legally on your behalf.

Common uses: selling or buying a flat, registering a rent agreement with a tenant, collecting rent, paying property tax, closing a home loan, representing you in a society or court matter.

General or special POA?

A special POA is limited to one transaction — for example, “to sell Flat 504, Building B, XYZ Society, Kharadi and to execute and register the sale deed”. Sub-Registrars and buyers prefer this because the authority is unambiguous. A general POA covers ongoing management of property, bank accounts and tax matters. For a sale, use a specific property description and clearly list each power (sign, receive consideration, admit execution, register).

Step-by-step process

  1. Draft in India

Have the POA drafted by your Pune lawyer in the format the Sub-Registrar accepts. Include your passport details and the attorney’s Aadhaar and PAN.

  2. Sign abroad

Sign before the Indian embassy or consulate (consular attestation), or before a local notary and get an apostille if the country is a Hague Convention member. Attach passport-size photographs and identity copies.

  3. Courier the original

Send the original signed POA to your attorney in Pune.

  4. Adjudication within 3 months

The POA is presented to the Collector of Stamps in Pune, who assesses the duty; it is stamped within three months of its first receipt in India.

  5. Registration / use

Where the POA concerns immovable property, it is registered or presented with the document the attorney executes. The attorney then signs on your behalf.

Stamp duty on an NRI POA in Maharashtra

The duty depends on the powers granted and to whom. A general POA to a family member generally attracts ₹500. A POA that authorises sale of immovable property and is given for consideration, or to a non-family attorney, is charged as a conveyance on the market value. Because the difference can be lakhs of rupees, have the draft checked before you sign it abroad.

Mistakes that get NRI POAs rejected

  • Missing the three-month adjudication deadline — the POA then needs fresh execution or penalty.
  • Vague property description or powers that don’t mention “to admit execution and present for registration”.
  • Name mismatch between passport, PAN and property documents.
  • Photo and signature not on every page as required by the consulate.
  • POA executed by one co-owner only, when the property is jointly owned.
  • Using a POA after the principal has died — it ends automatically.

Tax points when an NRI sells through a POA

The buyer must deduct TDS under Section 195 on the capital gains (or on the sale consideration if no lower-deduction certificate is obtained) — a much higher rate than the 1% for resident sellers. NRIs often apply for a lower TDS certificate before the sale. Sale proceeds go to an NRO account; repatriation is permitted within RBI limits. Discuss with a chartered accountant before the deal.

Frequently asked questions

Can an NRI give power of attorney for selling property in India?

Yes. A special power of attorney signed at the Indian consulate or apostilled abroad, adjudicated in Maharashtra within three months, allows the attorney to sign and register the sale deed.

Is consulate attestation mandatory or can I use apostille?

Either works. In Hague Convention countries, notarisation plus apostille is accepted; otherwise sign before the Indian embassy or consulate.

What is the time limit for adjudicating an NRI POA in Maharashtra?

Within three months from the date the POA is first received in India.

Can my POA holder register a rent agreement for my Pune flat?

Yes. The attorney gives biometrics in your place, and the POA is attached to the e-registration.

Does the POA need to be registered?

When it concerns immovable property — for example, authority to sell or execute agreements — registration or presentation with the registered document is required by Sub-Registrars.
