Gift Deed vs Release Deed vs Will: How to Transfer Family Property in Maharashtra

Three documents, three very different results. Here is how Pune families decide between a gift deed, a release deed and a will — with stamp duty, tax and real-life examples.

Short answer

Use a gift deed to transfer property to a family member now (₹200 stamp duty for residential property to spouse, children or grandchildren); a release deed when co-owners such as legal heirs give up their share to other co-owners (₹200 for qualifying heirs); and a will when you want property to pass only after your death and keep the freedom to change your mind. Gift and release deeds are immediate and generally irrevocable; a will can be changed any time.

When a gift deed is the right choice

Choose a gift deed when you want the transfer to happen now: a parent putting a flat in a daughter’s name before her marriage, a husband adding his wife as owner, or grandparents settling a plot on grandchildren. With close family and residential or agricultural property, the ₹200 stamp duty makes it the cheapest transfer available.

The trade-off is control. Once the donee accepts and the deed is registered, you cannot take it back on a change of heart. Protect yourself by reserving a right of residence or life interest in the deed, and by writing a maintenance condition — courts have upheld cancellation of gifts under the Senior Citizens Act where children failed to look after parents.

When a release deed is the right choice

A release deed fits when the property is already jointly owned, most often after a parent dies without a will. Every legal heir becomes a co-owner. If the family agrees that the mother should hold the flat, the children release their shares to her; if one brother is keeping the ancestral house, siblings release to him (often with a cash settlement recorded in the deed).

Two limits: you can only release to someone who already has a share, and siblings are not in the gift-deed concession list — so a release between legal heirs is often far cheaper than a gift between them.

When a will is the right choice

A will suits anyone who wants to keep full ownership and control during their lifetime — to live in, rent out, sell or mortgage the property — while deciding who gets it afterwards. It costs nothing in stamp duty, and you can change it whenever family circumstances change.

The weakness is that a will speaks only after death, when you are not there to explain it. Unregistered, poorly witnessed or vague wills are the most litigated documents in Pune civil courts. Have it drafted by an advocate, signed before two independent witnesses, and registered.

After registration: update the records

Whichever route you take, the job isn’t finished at the Sub-Registrar. Update the property tax record, electricity connection, society share certificate, and the 7/12 or property card for land. For a will, the beneficiary does this after the testator’s death using the will and death certificate.

Frequently asked questions

Which is cheaper in Maharashtra — gift deed or release deed?

Both cost ₹200 stamp duty in their qualifying family situations. Gift deed concession covers spouse, children, grandchildren and wife of a deceased son for residential/agricultural property; release deed concession covers legal heirs releasing ancestral property to the deceased’s spouse, children or grandchildren. Outside these, both are charged at market-value rates.

Is a gift deed better than a will?

A gift deed transfers ownership now and avoids later succession steps, but you lose control. A will keeps control until death but can be challenged. Many families use both: gift what you are ready to hand over now, and will the rest.

Can a release deed be made in favour of a sister?

Yes, if she is already a co-owner — for example as a legal heir of a deceased parent.

Does a will need stamp duty or registration?

No stamp duty. Registration is optional but recommended.

Can parents cancel a gift deed if children do not take care of them?

A registered gift is generally irrevocable, but under Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, a tribunal can declare it void if the gift was made on the condition of providing basic needs and the donee failed to do so.
